Dearby Terms of Use
1. Acceptance of Terms
By downloading or using Dearby, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the App.
2. The Service
Dearby is a personal journal for place memories. You can save notes, photos, and times to places, then review those entries in Memories. Me lets you manage your profile, send feedback, read these Terms and the Privacy Policy, and delete your account.
Features may require device permissions (location, camera, or photos) and a network connection. Location is used only while the App is in the foreground, to tag a memory to a place.
3. License
We grant you a personal, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. This is a license, not a transfer of title. You may not copy, reverse engineer, scrape, resell, or otherwise misuse the service.
4. User Responsibilities
- Use Dearby only for lawful purposes.
- Only save places, photos, and notes you have a right to record.
- Do not use Dearby to track, harass, or document someone else’s private location without a lawful basis and their knowledge.
- Do not submit false, illegal, infringing, or harmful content.
- Do not attempt to harm or disrupt the App or other users.
5. Your Memories
You retain rights to the notes, photos, and other content you create. You grant us a license to host, store, and display that content as needed to operate the App for you. In this version, memories are not shared with other users. You can delete entries in Memories, or delete your account in Me.
6. Location
You control iOS location permission (When In Use). Place names and map pins may be incomplete or delayed. Dearby is a journal, not a navigation or emergency service — in an emergency, call your local emergency number.
7. No Fees in This Version
This version of Dearby is free to use. We do not offer subscriptions, trials, or other in-app purchases here. If paid features are added later, we will update these Terms and disclose prices in the App before you pay.
8. Disclaimer and Limitation of Liability
The App is provided “as is.” We do not guarantee uninterrupted GPS, perfect place names, or that stored memories will never be lost. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for how you use location or journal data.
9. Termination
We may suspend or terminate your access immediately, without prior notice, for any reason permitted by law, including breach of these Terms, abuse, or legal risk. You may stop using the App at any time and delete your account in Me.
10. Changes
We may update these Terms in the App. Continued use after the “Last updated” date means you accept the revised Terms.
